1. Who we are and what these Terms cover
These Terms & Conditions ("Terms") are a contract between you and Recovy Limited, a company incorporated in Hong Kong with registered office at 49 Austin Road, KL, Hong Kong (company registration no. 2897578) ("Strive", "we", "us"). They govern your use of the Strive website, web application and mobile apps, and all content, workouts and community features we provide (the "Service").
By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract. By using the Service you confirm this is the case. The Service is not directed at minors.
3. Your account
You must provide accurate information, keep your credentials confidential and notify us promptly of any unauthorised use. You are responsible for activity under your account. One account per person; accounts are personal and may not be shared, sold or transferred.
4. Subscription, free trial and billing
- Plans. Strive is offered as an auto-renewing subscription, billed monthly or yearly at the price shown at checkout. Prices may be displayed in your local currency; applicable taxes are added where required.
- Free trial. New subscribers receive a 7-day free trial. You will not be charged during the trial. Unless you cancel before the trial ends, your paid subscription starts automatically on day 8 and your chosen plan is charged to your payment method. One trial per person; we may withhold trials from repeat or fraudulent sign-ups.
- Reminders. We aim to email you before your trial ends as a courtesy, but it remains your responsibility to cancel in time if you do not wish to be charged.
- Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled.
- Price changes. We may change prices with at least 30 days' notice by email; changes apply from your next renewal. If you do not accept a change, cancel before it takes effect.
- Failed payments. If a renewal payment fails we may retry it and suspend access until payment succeeds.
- App-store purchases. If you subscribe through the Apple App Store or Google Play, billing, cancellation and refunds for that purchase are handled by the store under its terms.
5. Cancellation and refunds
You can cancel anytime in your account settings, in a few taps. Cancellation takes effect at the end of your current billing period (or trial); you keep access until then. Except where the law of your country gives you a non-waivable right to a refund, payments are non-refundable and we do not provide refunds or credits for partial periods, unused workouts or team switches. Nothing in these Terms limits your statutory consumer rights.
6. Health disclaimer and assumption of risk
Strive is a fitness service, not a medical service. Our coaches provide general fitness programming and instruction; they do not provide medical advice, diagnosis or treatment, and the Service is not a substitute for advice from a physician or qualified health professional.
- Consult a physician before starting any exercise program, especially if you are pregnant, have (or suspect) a medical condition or an injury, or have been inactive.
- Exercise carries inherent risks, including injury. You perform workouts voluntarily and at your own risk, and you are responsible for training within your limits, with suitable equipment and a safe environment.
- Stop immediately and seek medical attention if you feel pain, dizziness, shortness of breath or discomfort.
- Any guidance on habits or lifestyle shared in the Service is general information, not individualised medical or dietary prescription.
To the maximum extent permitted by law, you assume all risks associated with your use of the workouts and waive claims against Strive arising from that use, except where caused by our gross negligence or wilful misconduct.
7. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial fitness. You must not:
- copy, record, download (except where we provide the feature), redistribute, publicly perform or resell workouts, audio coaching, video or any other Service content;
- use the Service to build a competing product, or scrape, reverse-engineer or circumvent technical protections;
- share your account or provide the Service to others, including as a trainer using it with clients without a written agreement with us;
- upload malicious code or interfere with the operation of the Service.
8. Team chat and community rules
Team chat is provided so members and coaches can support each other. You are responsible for what you post. Do not post content that is unlawful, harassing, hateful, sexually explicit, dangerous health advice, spam or promotion, or that infringes others' rights or privacy. We may remove content and suspend or terminate accounts that break these rules, at our discretion and without notice.
You retain ownership of content you post and grant us a worldwide, royalty-free licence to host, display and distribute it within the Service for as long as it remains posted. Coach responses in chat are general guidance to the team, not personal medical advice.
9. Teams, coaches and changes to the Service
Workout plans, session lengths, features, teams and coaches evolve. We may add, modify or retire teams, replace coaches, and change weekly programming at any time. You may switch teams at any time at no extra cost. A change of coach or team lineup is not a defect in the Service and does not give rise to a refund, except where required by law.
10. Intellectual property
The Service and all its content — including workouts, programming, video, audio coaching, coach likenesses and voices, text, graphics, logos and software — are owned by Strive or its licensors and protected by intellectual-property laws. Except for the licence in section 7, no rights are granted to you. "Strive" and the Strive logo are trademarks of Strive; you may not use them without our written consent.
11. Third-party services
The Service relies on third parties such as Stripe (payments), Apple and Google (sign-in and app distribution) and video/content delivery providers. Their services are governed by their own terms, and we are not responsible for them. Links to third-party sites are provided for convenience only.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you materially breach these Terms (including chat rules, account sharing or payment fraud), or with notice if we discontinue the Service. On termination your licence ends; sections that by their nature should survive (including sections 6, 10, 13, 14 and 15) survive.
13. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that you will achieve any particular fitness result — results depend on factors outside our control, including your effort, consistency and health.
14. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill; and (b) our total liability for all claims arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or for fraud.
15. Indemnity
You will indemnify and hold Strive harmless from claims, damages and reasonable costs (including legal fees) arising from your breach of these Terms, your content, or your unlawful use of the Service.
16. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over disputes arising out of or relating to them — except that if the consumer-protection law of your country of residence grants you mandatory rights or a right to sue in your local courts, those rights are unaffected. Before starting formal proceedings, contact us at support@getstrive.app; most issues can be resolved quickly.
17. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will give at least 14 days' notice by email or in-app notice. Continued use after the effective date constitutes acceptance; if you do not agree, cancel your subscription before the changes take effect.
18. General
These Terms and the Privacy Policy are the entire agreement between you and Strive about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them as part of a corporate transaction. Notices to you may be sent to your account email.
